Buying a house: who chooses the notary?

You’ve finally found the house of your dreams and your promise to purchase is signed. You make a few calls and choose a notary you trust to finalize the big transaction. But does the seller have to approve your choice? Does he or she have any say in the professional you choose to do business with? We’ll tell you!
Who decides what?
By law, the buyer decides which notary will handle his file. The seller cannot refuse to sell or to work with this person. In the promise to purchase, the section on the choice of notary does not indicate that this decision must be submitted to the seller for approval.
With some exceptions, only the buyer has the authority to choose the notary. Do you think there are particularities that apply to your situation, or are they trying to make you change your mind? When in doubt, it is wise to ask the Chambre des notaires for the truth.
Did you know?
It is possible that some sellers feel uncertain about the buyer’s choice. After all, this decision is imposed on them and they have never received the services of this professional.
In a real estate transaction, the notary is neutral and impartial. He is neither the seller’s enemy nor the buyer’s friend. This means that the notary will not take sides if he discovers a problem. He or she will simply disclose the problem and advise everyone of the options available to resolve it. These are good reasons to be reassured.
Trust your notary to protect you!
